1. The petitioner is aggrieved by non-consideration of his application for being appointed as a temporary Mohammedan Marriage Registrar (MMR) at Egra. Such post fell vacant upon transfer of the incumbent. The rules provide that temporary registrar may be appointed by way of nomination till applications are invited for selection of the permanent MMR. Accordingly, the petitioner put forward his candidature by an application. Such application is at page 10 of the writ petition.

Mr. Galib, learned advocate for the State respondents, has furnished a report in the form of instructions issued by the OSD & Ex-officio Joint Secretary, Law Department, which indicates that the petitioner's application dated February 20, 20024 was acknowledged and the state government forwarded the prayer to the Inspector General of Registration. It has been stated that the state government will take appropriate steps

upon receipt of recommendations of the District Registrar, Purba Medinipur and the Inspector General of Registration, West Bengal. The said report is taken on record.

Under such circumstances, the writ petition is disposed of with a direction upon the concerned District Registrar and the Inspector General of Registration, West Bengal to take steps by giving their view and comply with such direction of the state government. If such recommendation is made available to the state government necessary action will be taken for appointment of temporary Mohammedan Marriage Registrar, in accordance with law. If the petitioner is not found to be eligible for nomination as temporary MMR, the reasons shall be intimated to the petitioner. The entire exercise will be completed within a period of two months from the date of communication of this order. The authorities shall also be liberty to take steps for appointment of permanent Mohammedan Marriage Registrar, as per the Rules.

4. Accordingly, the writ petition stands disposed of.

5. All the parties are directed to act on the basis of the server copy of the order.
