C.R.M. (M) 88 of 2025 In Re : An Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Raiganj Police Station Case No. 197 of 2023 dated 22.02.2023 under Section 302 of the Indian Penal Code.

Mr. Kunal Ganguly .... For the Petitioner Mr. Bibaswan Bhattacharyya Ms. Rajashree Tah .... For the State Leaned counsel for the petitioner submits that the petitioner is in custody for more than 2 years and there is no direct evidence connecting the petitioner to the crime. The wife of the landlord of the house where the petitioner used to reside with his wife has stated that she has heard about the death and nothing more.

Learned counsel for the State opposes the prayer. It appears from the post mortem report of the victim that her death was caused due to effect of manual strangulation. The petitioner is the husband of the victim. The statement of witness recorded in course of investigation implicates the petitioner and the material available on record prima facie suggests that the petitioner being the husband of the victim has murdered her. This Court is informed that out of 17 witnesses examination of 4th witness is in progress.

Considering the gravity of the offence and extent of complicity of the petitioner therein, prayer for bail is rejected at this stage.

However, considering the period of detention of the petitioner, learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
