The petitioner is the plaintiff in Title Suit No.273 of 2017, which is pending before the learned Civil Judge (Senior Division), 2nd Court at Barasat.

The order sheet has been placed before the Court in order to substantiate that since 2019 repeated adjournments have been taken.

Upon perusal of the order sheet, this Court is of the view that the petitioner is justified in filing this revisional application.

This Court has not gone into the merits of the suit. An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisionsal application upon the opposite party is not required. The prayer is innocuous.

Under such circumstances, the revisional application is disposed of with a direction upon the learned Civil Judge (Senior Division), 2nd Court at Barasat, to ensure that the evidence of the parties is concluded within two months from the next date fixed and thereafter conclude the suit within a year therefrom.

A copy of the revisional application along with a server copy of this order be served upon the opposite party within a week.

The revisional application is disposed of.

There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
