It is submitted in writing that she has no objection to engage the petitioners in any work. It is further submitted that the petitioners have refused to perform duties thereby impeding the project works. It is also submitted that payments to be made to workers under MGNREG Scheme, although released by the Gram Panchayat is not being passed on by the petitioners to the workers. Complaints in this regard are stated to have been received by the petitioners and have been transmitted to the B.D.O., Gazole, Malda.

Copies of the complaints have been produced before the Court. The report may be kept with the record.

Counsel for the State has also filed a report issued by the A.D.M., Malda. The A.D.M. submits that Supervisors under particular Gram Panchayat are required to be allotted work on rotational basis. The Pradhan has stated in writing that no new Supervisors have been engaged in the concerned Gram Panchayat.

The B.D.O., Gazole shall cause an enquiry into the allegations against the petitioners. The petitioners may be heard along with the complainants as also the Pradhan. Subject to any final result of the enquiry, the petitioners may be engaged by the Pradhan on rotational basis immediately.

This Court has reason to believe the submissions and report filed by the Pradhan, Ms. Baha Soren.

Hence, the writ petition is disposed of.

There shall be no order as to costs.

The reports filed by the Pradhan and the Additional District Magistrate of Malda may be kept with the record.

The personal presence of the Pradhan is dispensed with.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
