Upon filing of the writ petition, by an interim order dated May 10, 2016 a Coordinate Bench of this Court had granted an unconditional stay of the operation of the impugned order upon the petitioner depositing a sum of Rs.69,000/- with the Registrar General, High Court, Calcutta.
It is submitted by the petitioner that pursuant to the above order, the said amount had been deposited with the Registrar General, High Court, Calcutta.
On behalf of the respondent West Bengal State Electricity Distribution Company Limited it is submitted that the entire amount of Rs.69,000/-, has been deposited pursuant to the filing of the writ petition, the entire disputed amount has been paid to the respondent authorities. As such, the instant writ petition has, for all practical purposes, become infructuous.
In view of the above, W.P.A. No. 5467 of 2016 along with C.A.N. 3 of 2024 stand disposed of by permitting the petitioner to withdraw the said amount of Rs.69,000/-, alongwith accrued interest within two weeks from the date of communication of this order.
There shall be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance of all necessary formalities.
