Ct.No.28.

as C.R.M. (DB) 1137 of 2022 In Re: An application for cancellation of bail under Section 439(2) of the Code of Criminal Procedure.

In the matter of : Akshaya Kamila.

... Petitioner.

Mr. Saibal Mondal, Mr. Arindam Jana.

...for the Petitioner.

Mr. Navanil De.

...for the State.

Mr. Saibal Mondal with Mr. Arindam Jana, learned Advocates for the petitioner challenges order granting interim bail to the opposite party. It is submitted opposite party was released on interim bail on the same day he appeared before the Special Court without considering the case records as well as medical documents.

We have considered the materials on record. Court below has recorded reasons for granting interim bail. Hence, we do not wish to interfere with the said order.

It is, however, open to the petitioner to raise objection at the time of confirmation of the interim bail or seek cancellation of bail in accordance with law, if so advised. The application is accordingly disposed of.
