Petitioner is aggrieved that the information which was furnished to the Officer-in-charge, Raina Police Station was not acted upon. Petitioner claims that by way of inheritance he has become owner of the property. On the other hand, learned advocate for the respondent no. 4 submits that the claim made by the petitioner relating to the factum of being owner by inheritance is disputed. Since a dispute relating to a property is the subject matter it would be in the interest of justice that the civil court would adjudicate the same.

State has submitted a report. Report reflects that a proceeding has been drawn up under

section 351(2) of the BNS. Having regard to the fact that the police authorities have already taken steps, I direct that they would continue the surveillance and would ensure that no breach of the peace and/or tranquility takes place and/or any untoward incident results from the strained relationship between the parties.

With the aforesaid observations WPA 8035 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
