An order passed by the Sub-Divisional Officer exercising jurisdiction under the provisions of the West Bengal Highways Act, 1964 is under challenge in the present writ petition.

The State is represented.

In the facts of the present case, since the impugned order is appealable under Section 10(4) of the Act of 1964, interference by a writ court at this stage not called for. In the event, the petitioner prefers any appeal within the period of fortnight from

date, the appellate authority is requested to consider such appeal to be within the period of limitation and dispose of such appeal on merits in accordance with the law.

W.P.A.5892 of 2020 [Old No.W.P.5892 (W) of 2020] is disposed of.
