Ms. Rituparna De Ghose Mr. Santanu Talukdar ... For the State The petitioner is in custody for 8 years and prays for bail. Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner was in the same room as the victim when the alleged incident occurred. He appears to be the principal assailant who assaulted the victim leading to his death. The petitioner owes an explanation under Section 106 of the Indian Evidence Act which may be dealt with at the appropriate stage of the proceeding.

Considering the material on record as well as the gravity of the offence, the prayer for bail is rejected at this stage The application for bail is disposed of.
