"After considering the stands of the respective parties before this Court, prima facie, I am not convinced that the petitioners are in settled possession of the relevant room in question. I am also, prima facie, satisfied that a separate connection to the individual occupiers of the building may compromise the safety of the building.

Respondent nos.4 and 5, however, submit that they will file an undertaking before this Court not to disrupt electricity connection of the petitioners.

Let such affidavit of undertaking be filed before this Court by seven days.

List this matter on June 30, 2025, under the same heading."

Today, an undertaking has been filed on behalf of private respondent nos. 4 & 5. The relevant part of the undertaking is quoted below:

"As directed by the Hon'ble Court we undertake to provide electricity in every room of the premises no. 6/1B, Abinash

Kabiraj Street Kolkata - 700006 in the usual manner as it is being provided since after our purchase from the electricity meter board subject to supply of electricity made available by the CESC Limited. We never disrupted supply of electricity in the rooms of the building and we undertake to provide continuous supply in the usual manner without any disruption from our end."

A copy of the undertaking has been made over to the learned advocate appearing for the petitioner. In that view of the matter, nothing further remains to be decided in this writ petition.

Accordingly, WPA 7936 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
