Nitya Nanda Poddar v. Prasanta Kumar Mukherjee

2023-12-18Hon'Ble Justice Prasenjit Biswas1 pages

18.12.2023 Srimanta Sl. No. 03 Ct. No. 655 CO/966/2003 Nityananda Poddar -Vs.- Prasanta Kumar Mukherjee Petitioner is not represented.

None appears on behalf of the opposite party. It appears that the instant revisional application was preferred challenging the impugned order dated 19.02.2003 whereby the learned Trial Court allowed the application filed by the plaintiff filed under Section 17(2)(2a) of the WBPT Act.

It appears that the matter is pending since the year 2003 and accordingly there is reasonable ground to believe that the petitioner is no longer interested to proceed with the present case. Accordingly, the revisional application being CO/966/2003 is dismissed for default.

Interim order, if any, stands vacated.

There will be no order as to costs.
