Ms. Sukanya Bhattacharya Mr. Parvej Anam ... for the State Learned senior counsel representing the petitioner submits that the two minor children received bomb blast injuries from a bomb that was allegedly hidden in the bamboo bush of the petitioner. It is an open area and anybody could have done the mischief. More importantly, the injured children are the grand children of the petitioner. Four other accused have been granted bail.

Learned counsel for the State opposes the prayer for anticipatory bail and relies on the case diary including the statements of the independent seizure witness and the statements of the injured grand children. She also relies on the statements of independent witnesses contained at pages

12 and 13 of the case diary who stated that the petitioner and others were in the business of keeping bombs in holes dug in their land. They used these bombs during elections and the like.

In view of the incriminating materials available in the case diary, especially the statements contained at pages 12 and 13 of the same, I am not inclined to grant anticipatory bail to the petitioner.

The application for anticipatory bail is, thus, rejected. (Jay Sengupta, J.)
