For the petitioner This revisional application has been filed with a prayer for expeditious disposal of the Title Suit No.631 of 2021 pending before the learned Civil Judge (Senior Division), 8th Court, Alipore, South 24-Parganas. Considering the facts and circumstances, I do not find any reason to ask the petitioner to serve notice upon the opposite parties. Thus, service of notice upon the opposite parties stands dispensed with.

From the records, it appears that an injunction application under Order 39 Rule 1 and 2 of the Code of Civil Procedure is still pending.

Accordingly, the learned Civil Judge (Senior Division), 8th Court, Alipore, South 24-Parganas, is requested to dispose of the injunction application under Order 39 Rule 1 and 2 of the Code of Civil Procedure, as expeditiously as possible, after giving opportunity of being heard to the parties to the suit.

With the aforesaid observation, the revisional application, being CO 1072 of 2023, stands disposed of. Learned advocate appearing on behalf of the petitioner is at liberty to bring this order to the notice of the learned Civil Judge (Senior Division), 8th Court, Alipore, South 24-Parganas, forthwith.

All parties shall act on the basis of a server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of necessary formalities.
