Re: CAN 5 of 2023 This application is filed for sending down the L.C.R. received in connection with FAT 1074 of 2007 to the learned Court of Additional District Judge-I, Jalpaiguri in order to enable the learned First Appellate Court to dispose of the T.A. No.4 of 2007 arising out of T.S. No.58 of 2004. The learned Counsel for the appellants has pointed out that the Special Leave Petition filed against the order dated 17th August, 2022 was dismissed.

Under such circumstances, the prayer is allowed. The department is directed to send the L.C.R. as prayed for to the learned Court of Additional District Judge-I, Jalpaiguri within two weeks from date. Accordingly, the application being CAN 5 of 2023 stands disposed of.

The Registrar Administration (L&OM) is directed to ensure compliance of this order.
