No. 29 CHC Rejected C.R.M.(A) 1428 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with NDPS Case No.106 of 2019 arising out of Hogalberia Police Station Case No. 234 of 2019 dated 05.12.2019 under Sections 21(c)/20(b) (ii)A/29 of the NDPS Act.

And In the matter of : Lakhim Mondal ...... petitioner Mr. Debarshi Brahma ....for the petitioner Mr. Saibal Bapuli, Ld. A.P.P.

Ms. Sayanti Santra ....for the State Petitioner was proclaimed as an offender. The police case is dated December 5, 2019.

In view of the long absconsion of the petitioner and in view of the petitioner being proclaimed as an offender the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1428 of 2023 is rejected.
