Affidavit-of-service filed in Court today be taken on record.

2.

The petitioner applied for inter district transfer from South 24 Parganas to East Midnapore on medical grounds.

3.

The Chairman, DPSC, South 24 Parganas has sought medical opinion on the petitioner's condition from the CMOH, South 24 Parganas and the matter is not proceeded therefrom.

In those circumstances, CMOH, South 24 Parganas shall furnish medical opinion on the petitioner's condition and forward the same to the Chairman, DPSC, South 24 Parganas. The Chairman, DPSC, South 24 Parganas shall thereafter forward the

said medical opinion along with their comments to the Secretary, WBBPE.

The WBBPE shall take a decision on the matter within 12 weeks from date strictly in terms of the applicable Rules.

Let the aforesaid exercise be carried out offline and a decision in this regard be communicated to the petitioner forthwith thereafter.

7.

Let a copy of this order along with a copy of the writ petition be served on the CMOH, South 24 Parganas, DPSC, South 24 Parganas and the Secretary of the WBBPE.

8.

With the aforesaid directions, the instant writ petition shall stand disposed of.

9.

There will be no order as to costs.

10.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
