The petitioner seeks implementation of the order passed by the Commissioner, Howrah Municipal Corporation dated December 15, 2020. The Howrah Municipal Corporation was directed by this Court to enquire and decide whether there has been any unauthorized construction by the respondent nos.6 to 11. Upon conducting a proper enquiry in accordance with the provisions of law, the Corporation has already taken a decision that the respondent nos.6 to 11 must remove the unauthorized construction as identified by the Corporation. The petitioner seeks implementation of this order.
Mr. Banerjee, learned advocate appearing on behalf of the Howrah Municipal Corporation fairly submits that the Corporation shall take necessary steps for implementation of the order dated December 15, 2020 as till now, no information has been received that the respondent nos.6 to 11 have challenged the order passed by the Corporation asking the said respondents to demolish the unauthorized construction .
It goes without saying that the Corporation shall be at liberty to seek police protection, if necessary. The learned advocate for the State respondents including the police authorities is present before this Court. All actions be taken by the Corporation in terms of the submission of Mr. Banerjee, within a period of eight weeks from date of communication of this order.
This writ petition is, thus, disposed of.
There will be no order as to costs.
All parties are to act on the basis of the learned advocate's communication.
