Petitioner alleges that the private respondents are interfering with the peaceful enjoyment of the property and to that effect, they had been creating disturbance and in spite of sending information to the Inspector-in-charge, Murshidabad Police Station no steps have been taken.

Learned advocate for the State submits that the police authorities have conducted an enquiry and in course of enquiry it revealed that a long standing land dispute exists between the petitioner and the private respondent no. 7. Considering the same, police authorities in order to maintain peace and tranquility drew up proceedings under section 126/135 of the BNSS, 2023.

Having regard to the fact that a long standing dispute is already pending and the civil court is already in seisin of P.S. No. 241/2024, I am of the view that the police authorities would abide by the directions of the civil court. In the meantime, police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations WPA 8034 of 2025 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
