Swapan Kumar Nandi, Sibnarayan Chattopadhyay with Sizan Nandi, Advocates present in court ..for the Petitioner Ms. Tuli Sinha, Advocate present in court ..for the State The learned counsel for the petitioner submitted that he may be permitted to withdraw the present writ petition as the petitioner has been acquitted by the competent court of law in the criminal proceeding pending against him, with liberty to challenge the impugned order of punishment by availing the appropriate remedy. In this case punishment was inflicted on the petitioner after holding regular departmental enquiry.

The writ petition is dismissed as withdrawn with liberty as prayed for.

However, it is made clear that we have not commented on the issue of limitation for availing remedy against the order of punishment.
