Mr. Kingsuk Mondal Mr. Golam Nure Imrohi Mr. Partha Pratim Sinha Mr. Suman Das Mr. Sumitra Das ..for the Petitioner Mr. Jahar Lal De Mr. Sutanu Chakrabarty ...for the State The petitioner complaints that despite an order passed by the learned trial Court restraining the private respondents from entering the property in question and directing the police to implement the said order, the private respondents are restraining the petitioner from raising construction in the property and are disturbing his peaceful possession therein.

It appears from the report submitted by the State that enquiry was held pursuant to the complaint lodged by the petitioner and prosecution has been submitted under Section 107 of the Code of Criminal Procedure. The report also indicates that the allegation of the private respondents is that the petitioner is trying to raise construction in the property without demarcating the same.

Upon consideration of the submission made by the parties this Court is of the view that since the

petitioner has been granted ad interim order of injunction by the learned trial Court, the police authority shall ensure that the private respondents do not violate the same. The police authority shall also keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall ensure maintenance of peace and tranquility.

The writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
