The petitioner claims parity with the co-accused who have been granted bail earlier. He is in custody for 248 days. Learned counsel for the State does not dispute the said claim of the petitioner.
In view of the fact that co-accused who are similarly circumstanced with the petitioner have been granted bail by this Court, the petitioner is entitled to the same relief. Accordingly, the prayer for bail is allowed.
The petitioner namely Krishna Barman shall be released on bail upon furnishing a personal bond of Rs.10,000/- (Rupees Ten Thousand only) to the satisfaction of the learned Additional Chief Judicial Magistrate, Ranaghat, Nadia subject to condition that he shall appear before the learned trial Court on every date of hearing fixed by the learned trial Court and he shall not tamper with the evidence or intimidate the witnesses in any manner whatsoever. In the event the petitioner fails to appear before the learned trial Court on any date fixed for hearing without any justifiable
cause, the learned trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court. The application for bail is disposed of.
