Rupsa Bhattacharjee nee Roy Chowdhury Mr. Santanu Mukherjee Ms. Gargi Saha Ms. Madhumita Kar ...for the petitioner Learned counsel appearing on behalf of the petitioner submits that she was granted maintenance allowance of Rs. 12,000 per month by the learned trial Court under the provision of the Protection of Women from Domestic Violence Act. In the meantime, the petitioner's annual income has increased from Rs. 5 lakhs to Rs. 22 lakhs. The petitioner's requirements have also gone up. Accordingly, an application for enhancement of maintenance was filed before the learned trial Court in the year 2023. But, the same has not been considered yet. As an application has been filed praying for expeditious disposal of the proceeding, no prejudice will be caused to anyone if an order is passed without directing service of notice upon the other side. It appears that although an application for enhancement of maintenance has been filed in the year 2023, the same has not been decided as yet.

In view of the above, the learned trial Court is requested to conclude the proceeding for enhancement of maintenance allowance in accordance with law and as expeditiously as possible by keeping in mind the statutory stipulations provided under the said Act for expeditious disposal of a proceeding.

With these observations, the writ petition is disposed of.
