The parties share different portions of the same premises. The dispute between the parties relates to laying down of water pipe for supplying water to the writ petitioner/private respondent. We had referred the disputes for mediation. Mediation has been successful. Finally, report of the Mediator has been placed on record. Terms of Settlement filed by the parties have also been placed on record.

In that view of the matter, we need not discuss the nature of the dispute or keep this appeal pending any further.

The parties and the Uluberia Municipality shall act in accordance with the Terms of Settlement arrived at by and between the parties. The Municipality, although it is not a party to the Terms of Settlement,

says through its learned Advocate that it shall do the needful for ensuring that water is supplied to the writ petitioner. The Municipality shall make all endeavours to give the water connection at the earliest and in any event not later than 15 days from date.

Needless to say, the expenses of giving water connection to the writ petitioner will be borne as indicated in the Terms of Settlement.

M.A.T. 655 of 2022 is, accordingly, disposed of along with IA CAN 1 of 2022.

Urgent photostat certified copy of this order, if applied for, be supplied expeditiously after compliance with all the necessary formalities.
