Kausik (Allowed) CRM (NDPS) 649 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with New Barrackpore Police Station Case No. 254 of 2025 dated 04.09.2025 under section 20(b)(ii)(c)/29 of the NDPS Act.

Petitioner is a lady who has been arrested on 04.09.2025 and is in custody for 7 months. The alleged recovery was from the house of the petitioner which is 22.086 Kgs. of Ganja.

It has been pointed out by the State that the husband of the petitioner has criminal antecedents.

Be that as it may, petitioner is in custody for 7 months and the prosecution has relied upon 11 witnesses in order to prove its case.

Having considered the period of detention and time which will be required for taking the trial to its logical conclusion, I am inclined to release the petitioner on bail. Accordingly, Petitioner, namely, Sadhana Biswas shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of Learned Special Judge, (NDPS Act), Barrackpore.

If on bail, petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of 24 Parganas North without the prior permission of the learned Special Court. Accordingly, CRM (NDPS) 649 of 2026 is allowed. Memorandum of evidence submitted by the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
