The Counsel for the appellants submits that the instant appeal has been wrongly filed and because of the fatal defects he prays for withdrawal of the instant appeal with liberty to challenge the selfsame order before the appropriate forum.

In such view of the matter, the appeal is dismissed as withdrawn with liberty to the appellants to challenge the selfsame order before the appropriate forum. In view of the withdrawal of the appeal itself, the connected application being CAN 1 of 2024 has become infructuous and the same is also dismissed.
