Instructions dated April 15, 2021 are also produced.
It appears from the instructions that the wearing apparel found from the place of occurrence has indeed been seized. Let the same be sent for FSL, if not already sent.
The grievances of the petitioner that Sections 354B and 307 of the IPC, have not been included, is rather premature. The investigation has not been completed.
In that view of the matter, the Investigating Officer in this FIR being Chandrakona Police Station Case No. 42 of 2021, shall ensure that all relevant Sections are suitably considered, in the event, any final report leading to a charge sheet, emerges after investigation.
It is expected that the investigation is completed as expeditiously as possible preferably within a period of 45 days from date and a final report along with the annexures may be submitted before the Jurisdictional Magistrate. A copy of such report may be furnished to the counsel for the petitioner.
With the aforesaid observations, the writ petition is disposed of.
There shall be no order as to costs.
The instructions of Chandrakona Police Station dated April 15, along with annexures, be kept with the record.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
