A.P.P., Mr. Manoranjan Mahata. ... for the State. The application under Section 438 of the Code of Criminal Procedure has been filed apprehending arrest in connection with Memari P.S. Case No. 445 of 2014 dated 13.08.2014 (G.R. No. 2973 of 2014) under Sections 147/148/149/ 341/324/ 325/326/ 307/ 302 read with Sections 3/4 of the Explosives Substances Act. The offence under Sections 3 and 4 of the Explosive Substances Act has also been alleged against the petitioner.

It is submitted by the Counsel for the State that the charge sheet has been filed in the year 2015 and the petitioner has been absconding.

Although Counsel for the petitioner submits that he is a Government employee and is regularly attending his office, this Court is of the view that the petitioner has not been able to make out a case under Section 438 of the Code of Criminal Procedure. Hence, the application for anticipatory bail being C.R.M. 3148 of 2021 is, thus, dismissed.

There shall be no order as to costs.
