Banerjee) Mr. Meghnad Dutta Mr. Abhishek Shaw ...for the petitioners This application under Article 227 of the Constitution of India is at the instance of the defendant nos. 4 and 5 praying for a direction upon the learned Civil Judge (Sr. Division) Arambagh to dispose of the application under Order 1 Rule 10(2) of the Code of Civil Procedure filed by the petitioners herein expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned trial Judge.

The learned advocate for the petitioners submits that the said application was filed by the petitioner on

March 29, 2022. The next date of hearing of the said application has been fixed sometime in the month of July, 2025.

In the light of the submission made on behalf of the petitioners, CO 1440 of 2025 is disposed of by requesting the learned Civil Judge (Sr. Division) Arambagh to take up the hearing of the said application under Order 1 Rule 10(2) CPC filed by the defendant nos. 4 and 5 on the next date fixed if the same is otherwise ready for hearing and dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties.

With the above observation and direction CO 1440 of 2025 stands disposed of.
