Pleader Mr. Prasanta Behari Mahata ..for the State The petitioners allege that the authorities of the Public Works (Roads) Department, Government of West Bengal is trying to encroach upon a portion of the property of the petitioners for the purpose of extension of the existing road without initiating any proceeding for acquisition. The petitioners claim to have submitted a representation dated 31st December, 2025 before the Executive Engineer, Public Works (Roads) Department, Howrah being the 4th respondent.

The learned advocate appearing for the petitioners submits that in spite of receipt of such representation no decision on such representation has been communicated to the petitioners till date.

Mr. Mahata, learned Additional Government Pleader submits that the decision on the representation shall be communicated to the petitioners within the time limit as may be fixed by this Court.

Without entering into the merits of the claim made by the petitioners in the representation dated 31st December, 2025, WPA 8458 of 2026 stands disposed of by the directing the Executive Engineer, Public Works (Roads) Department, Howrah being the 4th respondent to consider the representation of the petitioners dated 31st December, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioners or their authorized representative and communicate the reasoned order to the petitioners as expeditiously as possible but positively within a period of twelve weeks from the receipt of a server copy of this order along with a copy of the representation dated 31st December, 2025. It will be open to the 4th respondent to take the assistance of the concerned Block Land and Land Reforms Officer if any demarcation of the disputed property is necessary.

There shall be however no order as to costs.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
