Samik Basu v. State Of West Bengal
C.R.R.1051 of 2021 D/L44 13.02.2023 Bpg.
In Re: An application under Section 482 read with Section 401 of the Code of Criminal Procedure, 1973;
Sri Samik Basu
Versus
The State of West Bengal and another Mr. Arijit Ganguly, Mr. Koushik Kundu.
...for the State.
The grievance of the petitioner reflects that in spite of orders being passed directing for confirming the prayer for bail, the learned Magistrate has kept the same pending. As none appears on behalf of the State, Mr. Arijit Ganguly, learned advocate, who ordinarily appears on behalf of the State, is directed to represent the State. His appearance may be regularised by the concerned authorities. He is entitled to engage a junior of his choice.
Having considered the plight of the present petitioner, I direct that the initial interim order of bail was passed way back in the year 2019. More than 31⁄2 years have passed. Learned Additional Chief Judicial Magistrate, Alipore is directed that in case the interim bail has not been confirmed he should confirm the same at the earliest.
With the aforesaid observations, CRR 1051 of 2021 is disposed of.
Pending applications, if any, are consequently disposed of.
All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
