As the order dated 24.08.2023 stems out of an application under Section 439(2) of the Code of Criminal Procedure wherein direction was passed upon the C.I.D. to investigate and today when the matter has been called, a report has been submitted wherefrom it reflects that the investigation of the case is in progress. As such, I am of the view that at this stage, no further comments be made on the manner in which the investigation is under progress. It would be at the liberty of the investigating agency, if required to pray for custody of the accused persons concerned considering their complicity in connection with the instant case for the purposes and sake of investigation of the case to unearth the truth.

With the aforesaid observations, CRM (SB) 76 of 2023 is disposed of.

The report so submitted by Mr. Nandy, learned advocate appearing for the State be kept in a sealed cover along with the records of the case.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
