Learned lawyer for the petitioner submits that he is in custody for more than two years. It is submitted that he has been falsely implicated in the instant case.

Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. There are prima facie materials to show that the petitioner is a foreign national and had conspired with other accused persons to misappropriate a large sum of money.

We are informed that the date has been fixed for consideration of charge in January, 2022.

In view of the fact that the petitioner is a foreign national and considering the gravity of the offence and as the matter is fixed for consideration of charge, we are not inclined in granting bail to the petitioner at this stage.

The application for bail is thus rejected.
