This application under Section 482 of the Code of Criminal Procedure was filed seeking an order of quashment of the proceeding being Case No. C / 673 of 1994 pending before the learned 4TH Court of Metropolitan Magistrate, Calcutta. The application was moved on 7th of December 2011 and the petitioner was directed to serve notice upon the opposite party. However, from the record, I find that as there was no order of stay, trial commenced before the learned 4th Court of Metropolitan Magistrate, Calcutta and an application under Section 245(2) of Cr.P.C. was filed on behalf of the accused persons which was rejected. The said order passed by the learned Trial Court on 05.2.2009 was challenged in Criminal Revision No. 60 of 2009, learned Additional Sessions Judge, 9th F.T.C.

Bichar Bhawan, Kolkata was pleased to dismissed the revisional application by the order dated 30.11.2010. Therefore, there is every reason to presume that the proceeding before the learned Trial Court has reached its logical conclusion. This revisional application does not merit any consideration and is dismissed without any order as to costs.

Let a copy of the order be sent to the learned Trial Court for information and necessary action.
