The petitioner is the Headmaster of the educational institution/Madrasah, namely, "Parbaidyanathpur Shovapur Junior High Madrasah" at Village-Parbaidyanathpur, Post OfficeDeonapur, Police Station-Baishnabnagar, Sub-Division-Malda, District-Malda.
The petitioner's grievance is with respect to the alleged discrimination made to him in payment of salary as the Madrasah Headmaster.
Mr. Samim Ahammed, learned advocate on behalf of the petitioner has submitted by referring to Annexure P-4 i.e. a letter from the Director of Madrasah Education, West Bengal to the Secretary of the said Madrasah, i.e. dated July 23, 2010, that, with effect from the said date the Madrasah has got approval of the State Government. She has further relied on to the relevant document to submit that much before the date of approval of the Madrasah as above, the service of the petitioner has been approved in the said Madrasah as the Headmaster.
She has put forth the grievance of the writ petitioner that instead of approval of service, the writ petitioner has been illegally and unreasonably deprived of the benefits due as per the
Government norms, in terms of salary and other prerequisite eligible to be paid him, as the Headmaster of that Madrasah. The petitioner has communicated a written representation dated December 16, 2022 to the Secretary, Minority Affairs and Madrasah Education Department, Government of West Bengal/ respondent no. 1.
Learned advocate appearing for the petitioner submits that the said prayer of the present petitioner is yet to be considered and disposed of by the respondents.
In consideration of the facts and circumstances of the present writ petition, it is found proper to dispose of the same with the direction upon the respondent authority to dispose of the writ petitioner's representation dated December 16, 2022, by a reasoned order and also after affording sufficient opportunity of hearing to the petitioner and any other person as the concerned respondent would think fit and proper.
The entire exercise as above shall be concluded by the respondent within a period of eight weeks from the date of service copy of this order.
The writ petition being WPA 8092 of 2023 is disposed of.
