The petitioner is one of the defendants in Title Suit No.08 of 2019, which is pending before the learned Civil Judge (Senior Division), at Burdwan.

The petitioner submits that the suit is dragging since long and apart from an application for addition of party, all other interlocutory applications have been disposed of. It is also submitted that an application for addition of party is pending since 2022. The petitioner seeks orders for early disposal of the suit as also the pending application. This Court has neither gone into the merits of the suit nor into the merits of the application. An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisionsal application upon the opposite parties is not required. The prayer is innocuous.

Under such circumstances, the revisional application is disposed of with a direction upon the learned court below to dispose of the application for addition of party, upon granting the contesting parties one last chance to file written objection to the same, if not already filed, within two months from the next date fixed. Thereafter, the learned court below shall make all endeavour to ensure that the title suit is also disposed of within a reasonable time.

A copy of the revisional application along with a server copy of this order be served upon the opposite parties within a week.

The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
