For the Haldia Development Authority The order passed by the Sub-Divisional Magistrate, Haldia is assailed in the writ petition. The order is amenable to appeal under Section 7 of the West Bengal Pubic Land (Eviction of Unauthorised Occupants) Act, 1962. In view of the above, the petitioner seeks to withdraw the writ petition and approach the appropriate forum for redressal of his grievance.

Accordingly, the writ petition being WPA 7717 of 2022 is dismissed for non-prosecution.

Liberty is granted to the petitioner to approach the appropriate forum for redressal of his grievance. In the event the petitioner prefers statutory appeal within 15 days from date, the appellate authority shall deal with the appeal on merits without dismissing the same on the ground of limitation.

There shall be no order as to costs.
