The allegation of the petitioners in this writ petition is that, although the Secretary, Regional Transport Authority, North 24 Parganas had given a hearing to the petitioners on the allegation contained in W.P. No. 7754 (W) of 2019, on July 9, 2019, the reasoned order as directed by this court to be passed, has not yet been passed.
Mr. Amal Kumar Sen, learned advocate, who usually appears in these matters is requested by the court to accept the brief on behalf of the RTA. Mr. Sen submits that as the hearing has already been given to the petitioners, the allegation need not be revisited. Mr. Sen further submits that the writ petition may be disposed of with a direction upon the RTA, North 24 Parganas to pass a reasoned
order on the basis of the hearing given to the parties, if not already passed.
Mr. Nandi submits that even if the reasoned order has been passed, nothing has been communicated to his clients.
Thus, this writ petition is disposed of with a direction upon the Secretary, Regional Transport Authority, North 24 Parganas to pass a reasoned order (if not already passed) and mandatorily communicate the same within a period of three weeks from the date of communication of this order. It is made clear that this court has not gone into the merits of the claims and counter-claims of the parties and the petitioners will be at liberty to take such steps as may be deemed fit and proper under the law once the order is communicated to them.
The Office of the learned Government Pleader is directed to regularize the appearance of Mr. Sen. Parties are to act on the server copy of this order.
