Kausik CRM (NDPS) 651 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Hili Police Station Case No. 180 of 2025 dated 05.09.2025 under Sections 21(c)/22(c)/23(c)/27A/28 of the NDPS Act, 1985. And In the matter of : Bapi Tambuli ......Petitioner.

Mr. Arijit Ganguly Mr. Nirupam Dhali ......for the State.

Learned advocate appearing for the petitioner submits that the alleged recovery in the present case is 94 bottles of RCKuff Cough Syrup and the petitioner is in custody for more than 7 months.

Learned advocate prays for bail as there is no possibility of the trial concluding as 17 witnesses have been relied upon by the prosecution in the charge sheet.

Learned advocate for the State opposes the prayer for bail and submits that there are 4 antecedents of the present petitioner involved in different types of offences.

Having considered the fact that the petitioner is in custody for 7 months, I direct the learned Trial Court to release the petitioner on bail after the evidence of the seizure list witnesses are over.

Learned Trial Court would expedite the stage of consideration of charges and thereafter within 60 days examine the seizure list witnesses.

With the aforesaid observations CRM (NDPS) 651 of 2026 is disposed of.

Report submitted by the State be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
