Learned advocate appearing for the petitioner submits the subject matter of case relates to alleged recovery of 47 bottles of phensegrip from the house of the petitioner. Petitioner is in custody for seven months and charge-sheet has already been submitted.

Learned advocate for the State opposes the prayer for bail but is unable to refute the aforesaid contentions. Learned advocate submits two of the other accused persons is absconding.

Having regard to the quantum of seizure, period of detention of the petitioner as well as the time which would be consumed for taking the trial to its logical conclusion, I am inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Bapi Barman shall be

released on bail upon furnishing a bond of Rs.20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Special Judge, under NDPS Act,- cum-learned Additional District Judge, 3rd Court at Dakshim Dinajpur. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Dakshin Dinajpur, without the prior permission of the learned special court.

Accordingly, CRM (NDPS) 653 of 2026 is allowed. 6.
