The petitioner is in custody for one year 6 months. Learned counsel for the petitioner submits that since recovery has already been made from the petitioner and trial has commenced, his further detention is not required.
Opposing the prayer learned counsel for the State submits that the petitioner has criminal antecedents and an earlier FIR alleging offence under Section 489B/489C of the Indian Penal Code is pending against him. Out of 11 witnesses, 5 witnesses have been examined.
Considering the material available on record as well as conduct of the petitioner, prayer for bail is rejected at this stage. Learned trial Court is directed to take the proceeding to its logical conclusion as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law.
The application for bail is disposed of.
