Petitioner seeks benefit of his past eight years of service that he rendered at Visva Bharati as an Office Assistant from December 31, 1974 to December 07, 1982. He retired as an Associate Professor in the year 2009 from Burdwan Raj College.
Seeking benefit of his past service in his retiral dues, the petitioner made a representation before the Burdwan Raj College and the College, in turn, forwarded the necessary documents to the Director of Public Instruction, West Bengal.
It appears that by a letter dated March 12, 2015, the Director of Public Instruction requested the College to provide some information as raised by the Finance Department for counting of his past service towards his pensionary benefits.
The College, accordingly, forwarded the papers to the Director of Public Instruction on June 16, 2015. The Director of Public Instruction again by a letter dated November 28, 2016 asked for certain
documents and clarifications with regard to the prayer of the petitioner and the College by a letter dated June 28, 2017, forwarded the last pay certificate of the petitioner along with necessary documents to the Director of Public Instruction. It is the grievance of the petitioner that till date no decision has been taken by the Director of Public Instruction for granting him the benefit of his past service rendered at Visva Bharati. In view of the aforesaid facts, this writ petition is disposed of with a direction upon the Director of Public Instruction, West Bengal to consider the case of the petitioner for granting him the benefit of his past service at Visva Bharati.
The petitioner will make a further representation before the Director of Public Instruction enclosing all the necessary papers and the Government Circular within two weeks from date. The Director of Public Instruction shall take a decision in accordance with law after hearing all the necessary parties including the petitioner within a period of two months from the date of communication of this order.
Accordingly, WPA 6596 of 2018 is disposed of. There will be no order as to costs.
