Petitioner is aggrieved by the obstructions and disturbances created by the private respondent and to that effect, information was furnished to the Inspector-in-charge, Chakdah Police Station.

However, in spite of the same being brought to the notice of the concerned police station no steps have been taken and the contention of the petitioner is that the private respondents are dismantling the trees.

State has submitted a report. Report reflects that Title suit no. 33 of 2025 is pending before the learned Civil Judge (Senior Division), Kalyani. Since the civil court is already in seisin of

the issue, I am of the view that the subject matter relating to disputes arising from the land would be considered and adjudicated by the civil court already in seisin of the issues. However, police authorities would only ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the inimical relationship existing between the parties.

With the aforesaid observations WPA 8123 of 2025 is disposed of.

Report so submitted be kept with the record.
