1. Affidavit of service filed on behalf of the petitioner is taken on record.

2. Matter is heard in presence of the learned advocates representing the parties.

3. Petitioner made a prayer for correction of his date of birth as recorded in the certificate issued by the West Bengal Board of Secondary Education (for short 'Board') in connection with petitioner's participation in Madhyamik Examination 1987. According to the petitioner his date of birth was wrongly recorded in certificate relating to Madhyamik Examination as 11th April, 1968, his correct date of birth is 11th April, 1970.

4. On perusal of the order passed by the Deputy Secretary (Law Cell) dated 25th January, 2024

it appears that giving certain reasons prayer of the petitioner for correction of date of birth was refused. On consideration of the relevant facts it further appears that petitioner participated in Madhyamik Examination 1987 and in the certificate date of birth of the petitioner was recorded as 11th April, 1968 whereas for the first time petitioner made a prayer for correction of date of birth by making an application on 15th May, 2012, precisely after twenty five years which goes to show that petitioner's application seeking correction of date of birth is afterthought. In the event it was a bona fide case of correction of date of birth, petitioner would have approached the concerned authority of the Board within the reasonable time after participation in Madhyamik Examination 1987.

5. Hence, order dated 25th January, 2024 passed by Deputy Secretary (Law Cell) requires no interference.

6. Writ petition stands dismissed.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
