The present revisional application was preferred challenging the orders dated 04.10.1999 and 05.10.1999 passed by the learned Metropolitan Magistrate, 4th Court, Calcutta in Case No. C/1388 of 1997 under Section 138 of the N. I. Act.

The interim order reflects that as the accused persons did not appear before the court it was directed by the learned Magistrate for issuance of order of attachment against the company and warrant of arrest against the accused persons fixing execution return on 20.12.1999.

Having regard to the purpose for which the revisional application was preferred and the records reflecting that the revisional application has not been admitted till date, I am of the opinion that with passage of time the purpose for which the revisional application was preferred has lost its force and it has become infructuous. . Accordingly, the revisional application being CRR 1395 of 2000 is hereby dismissed.

Pending applications, if any, are consequently disposed of.
