In Re : An application under Section 401 read with 482 of the Code of Criminal Procedure;

In the matter of : Niakat Hossain @ Niyamat Hossain ...petitioner. The present revisional application was preferred against the order dated 30.12.2011 passed by the learned CJM, Murshidabad.

I find that the grievance of the petitioner was an ex parte impugned order of maintenance of Rs.1500/- per month to the wife and Rs.1,000/- per month to the minor son.

The records of the present revisional application reflect that the revisional application appeared on 11.06.2012, 25.06.2012, 2nd July, 2012, 3rd September, 2012 and 11th September, 2012. The revisional application has not been admitted as is reflected from the orders referred to above.

I do not find that the order of the learned CJM is devoid any reasons or lacking any cogent reasons. Further, the quantum of Rs.1500/- per month and Rs.1,000/- per month so awarded are in consonance with the expenditure required for an individual to survive. Having regard to the same, no interference is called for. As such, CRR 1155 of 2012 is dismissed.
