1. This revisional application is directed against an order dated March 9, 2026, passed by the Learned Judge-In-charge, 3rd Bench, Presidency Small Causes Court at Calcutta in Ejectment Execution Case No. 117 of 2023, whereby the Learned Trial Court has directed execution of writ of possession through police help.

2. The petitioner has assailed this order before this Court contending that the petitioner has medical problems and that some more time should be granted to the petitioner.

3. Mr. Bhattacharya, Learned Advocate appearing for the petitioner submits that the petitioner has undergone knee surgery and a further month's

time may be granted to the petitioner to vacate the premises.

4. The opposite party no.2 appears in person. The opposite party nos.1 and 3 are represented being Mr. Singh the Learned Advocate. It is submitted on behalf of the opposite parties that the opposite party no.1 is also a senior citizen and is bed ridden and the suit premises is urgently required for the use of the opposite parties.

5. It is further submitted by the opposite parties that the petitioner has already vacated the premises substantially and the present prayer is being made only to harass the opposite parties.

6. It is noticed that the ejectment suit is of the year 2013, which was decreed on May 18, 2023. The decree has withstood the challenges at the first and the second appellate stages and is now in final stage of the execution.

7. It is noted that the petitioner has enjoyed the property for almost 2(two) months, even after the date that was fixed for delivery of possession by the impugned order dated March 9, 2026. This revisional application was filed on April 02, 2026. In such view of the matter, there is no scope for this Court to grant any further time to the petitioner.

8. In any case, the order dated March 9, 2026 does not suffer from any illegality or material of irregularity. Therefore, this Court finds no reason to interfere with the impugned order.

9. C.O.1219 of 2026 stands disposed of. There will be no order as to costs.

10. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
