In the matter of : An application under Section 482 read with Section 401 of the Code of Criminal Procedure. Mr. Bidyut Kumar Roy ......for the State.

This revisional application was preferred challenging the proceedings arising out of Kaliaganj Police Station Case No. 72 of 2012 dated 14th February, 2012 under Sections 448/427/379/506/34 of the Indian Penal Code. Record of this revisional application reflects that on 22nd March, 2012 when the revisional application came up for hearing it was directed to be placed before the regular Bench. The revisional application is pending for more than 9 years before this court and the subject matter of challenge has never been canvassed.

In view of the fact there was no order restraining the proceeding before the learned court below and the

revisional application has been pending for more than 9 years, I am of the view that any interference at this belated stage may prejudice either of the parties when the status of the proceedings before the learned court below are not presented before this court.

Accordingly, the present revisional application being CRR 1157 of 2012 is dismissed.

All pending applications, if any, are consequently disposed of.
