AD 8 April 30, 2025 Ct. 28 SG CRM(A) 1202 of 2025 Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Uluberia P.S. Case No.322 of 2024 dated 17.08.2024 under Sections 318/316(6)/338/336/3(5) of the BNS corresponding to Sections 420/406/467/468/34 of the IPC. And In the matter of:

Anita Bera ... petitioner Mr. Soumya Banerjee Ms. Sucheta Banerjee ... for the petitioner.

Mr. Suman De Ms. Puspita Saha ... for the State Report filed by the State is taken on record. A certificate issued by the Pradhan of Hatgachha-II Gram Panchayat shows that although the grandfather of the present petitioner apparently passed away a few years ago, there is no record available with the Panchayat in this regard. The whole issue is about whether the petitioner forged the signature of the grandfather in the deed of gift that was executed.

It appears that several relevant documents have been seized. Investigation is going on.

In view of failure of the investigating agency to find out any record regarding death of the petitioner's grandfather and considering the fact that most of the other relevant documents have been seized in this case, which is primarily

based on documentary evidence, I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioner shall cooperate with the investigation, shall meet the investigating officer once a fortnight till submission of report in final form and shall not threaten or intimidate witnesses.

The application for anticipatory bail is, thus, allowed. (Jay Sengupta, J.)
