The grievance of the petitioner is directed against inaction of the respondent no. 3 in disposing of the representation dated March 4, 2024.

Briefly, the petitioner complains of the private respondents carrying on illegal and unauthorized construction of a building without obtaining any permission or sanction plan from the local Panchayat Authority.

The State has filed a Report through the Officer-in-Charge, Anandapur PS, Paschim Medinipur in Court and relies on the contents to suggest that the private respondents have been carrying out illegal and unauthorized construction and criminal proceedings have been initiated against him.

The private respondents are represented and submit that there is no illegal nor unauthorized construction and valid sanction has been obtained from the Appropriate Authority in accordance with law in respect of any construction carried out by the private respondents.

Having considered the submissions made on behalf of the parties, WPA 8814 of 2024 stands disposed of by directing the respondent no.

to consider and dispose of the representation of the petitioner dated March 4, 2024 and in accordance with law. The above exercise is to be completed within six weeks from the date of communication of this order.

With the above directions, WPA 8814 of 2024 stands disposed of.

In considering the above representation, the respondent no. 3 shall not be influenced by any observation or finding in this order.

A copy of the Report filed on behalf of the State Authority would be handed over on the Advocates appearing on behalf of the private respondent within the course of the day.
