Petitioner is directed to serve a copy of the revisional application upon Ms. Sujata Das, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularised by the concerned authorities.

Records of the revisional application reflect that the petitioner was granted bail on or about May, 2018 and since then he was on bail. However, subsequently warrant of arrest has been issued against the petitioner because of non-appearance. The allegations are under Sections 399/402 of the Indian Penal Code and Sections 25/27 of Arms Act.

Having regard to the undertaking given by the learned advocate appearing for the petitioner that henceforth the petitioner would abide by the conditions imposed by the learned ACJM, Chandannagar, Hooghly or the learned trial court, I direct that in case the petitioner surrenders by 30th September, 2023 before the learned trial court, he would be allowed to continue on the same

bail and bond but subject to conditions so imposed by the learned ACJM, Chandannagar, Hooghly which would incorporate the conditions for ensuring the appearance of the petitioner in connection with Haripal Police Station Case No.96 of 2017. The execution of warrant of arrest be stayed till 3rd October, 2023.

In case the petitioner do not surrender by 30th September, 2023, the learned ACJM, Chandannagar or the court in seisin of the matter would take steps for issuing process under the provisions of Section 82 of the Code of Criminal Procedure. With the aforesaid observations, CRR 1226 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
